Interactive Health Solutions SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Interactive Health Solutions does not warrant that the Member's or other user's use of interactivehs.com or Interactive Health Solutions Software shall be uninterrupted, always available or error free or shall meet a Member's or user's requirements, or that all defects in interactivehs.com or Interactive Health Solutions Software shall be corrected. Interactive Health Solutions DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, THE AVAILABILITY OF THE interactivehs.com SERVICE, INCLUDING WITHOUT LIMITATION UNAVAILABILITY CAUSED BY HEAVY TRAFFIC, TECHNICAL DIFFICULTIES OR ANY OUTAGE OR OTHER INTERRUPTION IN SERVICE.

Interactive Health Solutions owns and retains the copyrights and other proprietary rights in interactivehs.com and the Interactive Health Solutions Software. Except for public domain material, electronic mail and material on message boards, all copyrightable material displayed on, or downloaded from interactivehs.com is copyrighted, and may not be copied, performed, displayed, distributed, published, redistributed, transmitted or re-transmitted without permission of the copyright owner. No Member or other account user may remove, alter or cover any copyright or other proprietary rights notices placed on or in Interactive Health Solutions Software, and all materials on interactivehs.com.
Limitation of Liability
IN NO EVENT SHALL Interactive Health Solutions BE LIABLE (i) TO ANY MEMBER FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF PROGRAMS, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR SERVICE INTERRUPTIONS) ARISING OUT OF THE USE OF OR INABILITY TO USE interactivehs.com OR Interactive Health Solutions SOFTWARE, EVEN IF Interactive Health Solutions OR ITS AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR (ii) TO ANY PERSON OTHER THAN THE MEMBER. IN ADDITION, Interactive Health Solutions DISCLAIMS ALL LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS OR OMISSIONS OF OTHER SUBSCRIBERS, ACCOUNT USERS OR UNAUTHORIZED USERS (I.E. "HACKERS") OF interactivehs.com.
State by State Variation
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL DAMAGES, OR LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. These Terms give you specific rights, and you may also have other rights which vary from state to state.
General Provisions
These Terms, accepted upon registering for or first accessing interactivehs.com, contain the entire agreement between the Member, other account users and Interactive Health Solutions regarding the use of interactivehs.com and the Interactive Health Solutions Software, and may only be amended upon notice by Interactive Health Solutions to Members, or by a writing signed by the Member and the President of Interactive Health Solutions Unless otherwise explicitly stated, the provisions of these Terms shall survive termination of a Member's access to and use of interactivehs.com. This Agreement shall be governed by the laws of the State of Illinois, without regard to conflict of laws rules.
